The Philadelphia Court of Common Pleas jury ruled in favor of Monsanto in the Womack Roundup™ product liability trial overseen by Judge Michael Erdos. This decision is the third consecutive favorable outcome for Monsanto in the PCCP and aligns with 15 victories out of 22 trials concerning Roundup litigation.
In its official statement, Monsanto reiterated its commitment to the safety of Roundup™ products, emphasizing the extensive scientific and regulatory evidence supporting their non-carcinogenic nature. The company highlighted its reliance on scientific consensus and regulatory assessments globally, including those from the U.S. EPA.
Monsanto also addressed the preemption of state-based failure-to-warn claims by federal law, referencing the Third Circuit Court of Appeals’ Schaffner decision. This legal stance has created a circuit split, prompting Monsanto to explore a potential petition for certiorari to the U.S. Supreme Court, aiming for a decision during the 2025-2026 session.
Furthermore, Monsanto reaffirmed its commitment to advocating for legislative clarity to prevent litigation targeting pesticides approved by the EPA. It emphasized the critical role of Roundup™ products in enabling farmers to produce affordable food and contribute to global food security.
